Privacy policy

This Privacy Policy (hereinafter the Policy) applies to all user information stored at and received by ACS during the use of the website and the software and products supplied by ACS.

    1. This Policy contains the following terminology:
      1. “ACS Website Administration Team” (hereinafter the Administration Team) means a dedicated web administration team that acts on behalf of ACS, organizes and (or) ensures the processing of personal data, and defines the purposes of personal data processing, scope of personal data to be processed, and actions (operations) to be taken on personal data.
      2. “Personal data” stands for any information directly or indirectly related to an identified or identifiable individual (data subject).
      3. Personal data processing means any action (operation) or a set of actions (operations) carried out in respect of personal data with or without automated means, including collection, recording, classification, accumulation, storage, clarification (update, alteration), retrieval, use, transfer (dissemination, presentation, provision of access), pseudonymization, blocking, deletion and destruction of personal data.
      4. Data privacy means a binding requirement for the Data Controller or another party having access to personal data to prevent dissemination thereof in the absence of legal grounds or consent from the Data Subject.
      5. “User of the website” (hereinafter the User) refers to any person having an Internet access to, and using, the website
      6. “Cookies” means a small piece of data downloaded from the web server to the User’s computer and sent by the web browser or web client in an HTTP request every time the User attempts to access the relevant website.
      7. “IP address” stands for an individual address assigned to the User in a computer network based on the Internet Protocol.
    1. By using the website, the User consents to this Policy and the terms and conditions of processing of the User’s personal data.
    2. In case of disagreement herewith, the User shall cease the use of the website
    3. This Policy applies only to the website ACS has no control over, and bears no responsibility for, third-party websites that the User enters via the hyperlinks available on the website
    4. The Administration Team does not verify the personal data provided by the User of the website
    1. This Policy defines the obligations of the ACS Website Administration Team with regard to non-disclosure and protection of personal data provided by the User at the Administration Team’s request when registering with the website or placing a purchase order.
    2. The User’s personal data allowed for processing under this Policy is provided by filling in the registration form at the website and may include:
      • Full name
      • Phone number
      • E-mail
      • Registration address
      • Place of residence
      • Other information.
    3. ACS protects the data automatically transferred in the process of viewing the website, specifically:
      • IP address
      • Cookie data
      • Browser data (or data on any other software responsible for access to web advertisements)
      • Access duration
      • The address of the web page featuring an ad slot
      • Referer (previous web page).
    4. Deactivation of cookies may render it impossible to access ACS website parts that require a login.
    5. ACS collects statistics on the IP addresses of its website visitors. This information is used for identifying and addressing technical problems, and for checking the legality of payments.
    6. Any other information not mentioned above (purchase history, browsers and operation systems used, etc.) is subject to safe storage and non-disclosure, except in cases specified in Clauses 5.2 and 5.3 hereof.
    1. The Administration Team may use the User’s personal data for the following purposes:
      1. Identifying the User registered with the website ru for checking out ordered goods and (or) making online purchase agreements between ACS and the User
      2. Providing the User with access to personalized content of the ACS website
      3. Obtaining feedback from the User (including by notifications and requests related to the use the ACS website), provision of services, and processing of the User’s requests and applications
      4. Determining the User’s location for security and fraud prevention purposes
      5. Confirming the accuracy and completeness of personal data provided by the User
      6. Creating a customer account upon the User’s consent
      7. Sending order status notifications to the User
      8. Processing and receipt of payments, confirmation of taxes and tax benefits, payments disputes, determination of the User’s loan eligibility
      9. Providing the User with effective customer and technical support in cases of problems related to the use of the ACS website
      10. Providing product updates, special offers, price information, newsletters and other data upon the User's consent on behalf of ACS or its partners
      11. Display of advertisements upon the User’s consent
      12. Providing the User with access to the ACS partners’ websites or solutions for the purpose of using their products, updates and services.
    1. The User’s personal data are processed without time limit and in any lawful manner, including via personal data filing systems, with or without automated means.
    2. The User agrees that the Administration Team may transfer personal data to third parties, particularly courier or post services, and telecom carriers solely for the purpose of fulfilling the User’s orders placed on the website ru, including delivery of goods.
    3. The User's personal data may only be provided to the Russian authorities on the grounds, and in the manner, specified in the Russian law.
    4. In case of loss or disclosure of the User’s personal data, the Administration Team shall notify the User thereof.
    5. The Administration Team takes all necessary organizational and technical measures to protect the User's personal data against unauthorized or accidental access, destruction, alteration, blocking, copying, presentation, dissemination, or other unlawful third-party actions.
    6. In cooperation with the User, the Administration Team takes all necessary measures to prevent losses or other adverse consequences caused by loss or disclosure of the User’s personal data.
    1. The User shall:
      1. Provide the personal data necessary for using the ACS website
      2. Update or complement the available personal data in case it is changed.
    2. The Administration Team shall:
      1. Use the provided data solely for the purposes specified in Clause 4 hereof
      2. Ensure the safekeeping of confidential information, refrain from disclosure thereof without the User’s prior written consent, and abstain from selling, exchanging, publishing or otherwise disclosing the User's personal data, except in cases specified in Clauses 5.2 and 5.3 hereof
      3. Take precautions for keeping the User’s personal data confidential in line with standard business practices used for protection of such data
      4. Temporarily block the User’s personal data upon application or request from the User, their legitimate representative or data protection authorities if inaccurate personal data or unlawful actions are detected.
    1. In case of failure to perform its obligations, the Administration Team shall be liable for losses incurred by the User due to unauthorized use of their personal data in accordance with the Russian law, except in cases specified in Clauses 5.2 and 5.3 hereof.
    2. In case of loss or disclosure of the User's personal data, the Administration Team is relieved of any liability if the said personal data was:
      1. Known to general public before its loss or disclosure
      2. Obtained from a third party prior to receipt thereof by the Administration Team
      3. Disclosed upon the User’s consent.
    1. Prior to court examination, any disputes between the User and the Administration Team shall be followed by submission of a claim (a written offer to settle the dispute out of court).
    2. The recipient of the claim shall, within 30 calendar days upon receipt thereof, consider it and notify the claimant in writing of their decision.
    3. In case of failure to reach an agreement, the dispute shall be referred to court in accordance with the applicable Russian law.
    4. This Policy and relationships between the User and the Administration Team are governed by the applicable Russian law.
    1. The Administration Team may amend this Policy without the User’s consent.
    2. The new Policy takes effect upon its publication on the ACS website, unless otherwise specified in the new edition hereof.
